CanCham Shanghai is delighted to invite you to our upcoming event about Navigating Compliance in China - updates on corporate tax, mitigating fraud risk and environmental law. The business seminar will be divided into four sessions.

Sally Xu will first brief on the latest tax development by focusing on the corporate income tax (CIT) and Value Added Tax (VAT), as well as the key targets of tax audit in 2017 which normally follows the annual CIT filing.

While reforming these taxes, the Chinese government is also amid its crackdown on corruption; this has been one of the major cornerstones of President Xi Jinping’s administration. The unprecedented anti-corruption effort throughout China has exposed a business culture in which the public and private sectors are both plagued with fraud. Multinational corporations operating in China have now been given notice that China’s enforcement agencies will not tolerate corruption or any other form of fraud. During his presentation, Tim Klatte will discuss the following topics: (1) Current fraud trends and the anti-corruption campaign in China; (2) How to identify and detect red flags that may be apparent from headquarters.; (3) Recommendations for Canadian companies to mitigate fraud schemes in China; and (4) Best practices Canadian companies should consider in responding to fraud.

Then the seminar will focus on how to mitigate fraud risk while following compliance obligations within the environmental sector. CEOs these days are routinely put into only administrative detention for major infringements. In fact, environmental law in China have long had the stigma of being a toothless tiger. But more rigorous new laws and policies, paired with enhanced enforcement resources, are gradually transforming the environmental landscape and brought 'environmental compliance' to the forefront for the first time. In his presentation, Peter Corne will look at the nature of these changes, the effect it has regarding compliance, and new business opportunities that are arising as a result.


Finally, the seminar will end with a panel discussion on "Sharing best practices when navigating in China" and experts will provide tips and suggestions on tax, risk management and other legal issues.

    Sally Xu

    Tax Partner, ACCA at Grant Thornton

    Sally Xu is a tax partner of Grant Thornton's Shanghai office. She has accumulated rich experience in providing tax and transfer pricing advisory services in aspects of supply chain management and optimization, business restructuring, tax due diligence, tax risk control and planning, as well as cash repatriation to various multinational corporations. Sally has also assisted dozens of companies to explore inbound and outbound investment opportunities.

    The clients served by Sally include machinery, consumers, luxury, electronics, telecommunication, pharmaceuticals, chemicals, e-commerce and services.

    Sally is the Champion of the China (Shanghai) Free Trade Pilot Zone in Shanghai office and has assisted many clients in conducting investment navigation.

    Prior to joining Grant Thornton, Sally worked with PricewaterhouseCoopers and Ernst & Young.

    Sally has received her Bachelor and Master Degrees from Shanghai Jiaotong University, China.

    She is a member of the Association of Chartered Certified Accountants (ACCA).

    Tim Klatte is a Partner in the Forensic Advisory Services practice of Grant Thornton China and is located in the Shanghai office. He has extensive leadership experience in business & competitive intelligence, due diligence investigations, and China macro/micro economic forces that shape boardroom decisions and foreign policy. He has conducted nearly 200 due diligence and corporate intelligence projects across multiple industries and in all regions of China. His clients have included Global Fortune 500 firms with extensive operations in China.

    He holds more than 20 years of China-related experience, of which over 10 years have been working in Shanghai with both a Big Four Accounting firm and the leading Chinese investment management firm. Now with Grant Thornton, Tim leads the Forensic team in Shanghai and serves clients nationally. Prior to working in China, he served in the U.S. State Department and his last Diplomatic post was at the United Nations in New York, focused on US-Sino economic relations.

    Tim is a seasoned international professional providing timely and accurate risk analysis to national security officials, executives and senior decision makers in both the public and private sectors since 1995. Tim holds an MBA, with a concentration in International Business. He is currently completing his DBA studies and his Doctoral dissertation is entitled, “Strategies for Effective Offshoring to China in the United States Manufacturing Industry”.

    Peter has been involved in helping foreign companies identify and implement renewable energy and cleantech projects in the China market since 2003. He has developed a robust clean technology and renewable energy practice in China focusing on carbon credit generation and trading, M&A, greenfield projects and collaborations with Chinese parties. He has implemented projects in the solar, electric vehicle, energy storage, biofuel, wind, water treatment, carbon capture and reutilization, cleaner coal, geothermal, soil restoration, and energy efficiency sectors in China.

    Recently Peter has completed a number of projects in the area of energy management contracting in the industrial and built environments, which involve the management of various inputs such as renewable energy, water and heat, through web-based IT platforms. Peter is currently Vice-Chair of the Energy Working Group of the European Union Chamber of Commerce in China and was a supporter and sponsor of the China Greentech Initiative from its launch in 2009 until its conclusion in 2014.

    Some signature deals in which Peter has led as legal advisor include:
    • Putting in place one of the largest clean development mechanism (CDM) projects under the Kyoto Protocol for a consortium of Japanese investors
    • Acting for a large Chinese steel manufacturer in one of the largest energy efficiency CDM projects
    • Engineering a split and assets transfer of a major chemical facility in Shanghai, in the process addressing government concerns in respect of wastewater treatment to secure multiple relevant approvals
    • Helping an environmental company to execute the largest M&A project up to that time in the western regions of China
    • Setting up a series of R&D collaboration projects with leading Chinese research institutes to develop and deploy strategic cleantech solutions to address China’s environmental problems
