In the past few years, compliance has been a hot topic. The Chinese government has mainly targeted officials (tigers and flies), but plenty of international companies have been investigated as well during the years. R&P China Lawyers has supported businesses not only to identify and deal with high risk areas, but also to investigate non-compliance and support clients on responding to government investigations. Business Continuity Trends

Business Continuity and Organizational Resiliency are often misunderstood. They are often viewed as “Insurance”, “Information Technology Department’s Problem”, “Only for Catastrophes”, or “The Big Code Red Binder on the Shelf”, amongst other misperceptions. They are also viewed as highly complex and technical, with jargon and acronyms that only practitioners understand. Practitioners and consultants often contribute to this misunderstanding with over-complication and ‘scary-speak’.

This business-based discussion aims to explain these technical concepts in Plain English with examples and audience participation. Armed with this information, Risk Managers can have meaningful discussions with their peers and leadership based on business value. Risk Managers can also have meaningful discussions with practitioners and vendors or consultants to understand the concepts without falling victim to over-complication or inappropriate selling of solutions.

    Maarten Roos is the founding partner of R&P China Lawyers. He advises and represents European and American companies with business interests in China, mainly relating to investment projects and corporate activities, commercial transactions, corporate governance and compliance matters, and dispute resolution. He has worked on numerous complex transactions including M&A deals, corporate (re-)structuring and company liquidations, and frequently represents foreign clients in negotiations with Chinese business partners and government officials. Maarten also serves on the supervisory board of the subsidiaries of several multinational companies.

    Howard Mannella, CBCP, MBCI, is a seasoned executive in Business Resiliency, Business Continuity, Disaster Recovery, Crisis Management and related disciplines. He has been a featured speaker at Continuity Insights, World Conference of Disaster Management, Partners in Emergency Preparedness, International Disaster Conference and Expo, Securities Industry Association, European Identity and Cloud Conference, InterCEP, The Asian Banker, Qatar Annual Risk Forum and numerous executive venues, as well as testimony before the Securities and Exchange Commission.

    Mr. Mannella is currently Managing Principal of Alternative Resiliency Services Corp, a consultancy dedicated to evangelizing Organizational and Personal Resiliency. Recent work has included Operational Risk Assessment, IT Disaster Recovery Program Establishment, Business Continuity Planning and Emergency Notification Deployment for Banking, Service Provider and Member-Owned Services organizations. He was most recently Principal Resiliency Strategist for Expedia Inc, where he established and managed the global program for almost eight years. The program covered over 5,000 people in a dozen locations across North America and EMEA. His exercises presaged a number of actual events, and the program elements were proven in a number of real emergency situations.Mr. Mannella also drove Expedia's business impact planning for the 2009 H1N1 Flu Pandemic and 2012 London Olympic Games. Prior to Expedia, he was Senior Delivery Manager for an East Coast BC/DR consultancy, implementing plans and conducting exercises for blue-chip organizations in International Banking, Insurance, Pharmaceuticals, Internet/New Media, Defense/Aerospace and other sectors, some of which also were proven in actual events.
